The Federal Trade Commission has filed a lawsuit against Hims and Hers, the popular telehealth company, accusing it of improperly sharing sensitive health information of GLP-1 patients with Meta, the parent company of Facebook and Instagram. The complaint follows a nearly three-year investigation by the agency into the company's data handling practices.
According to the FTC, Hims and Hers disclosed details about users' prescriptions, including those for weight-loss drugs like Ozempic and Wegovy, to Meta's advertising and tracking systems without proper consent. The agency alleges that this sharing went beyond what was necessary for standard marketing analytics and violated the company's own privacy promises to customers.
The lawsuit claims that the health data was transmitted in a way that allowed Meta to link it to specific individuals, potentially exposing highly personal medical information to third parties. The FTC argues that such practices are especially concerning given the sensitive nature of weight-loss and reproductive health treatments, which can carry stigma and lead to discrimination.
Hims and Hers has responded by stating that it disagrees with the allegations and plans to fight the lawsuit. The company maintains that it has robust privacy protections in place and that any data sharing was done in compliance with industry standards and legal requirements.
This case highlights the growing scrutiny on digital health companies that rely heavily on targeted advertising. As more consumers turn to online platforms for medical care, regulators are increasingly focused on how these companies collect, use, and share patient information. The outcome of this lawsuit could set a significant precedent for the entire telehealth industry.
