Major grocery operator on the hook for $40M over pharmacy monkey business; $6M windfall for whistleblower

Major grocery operator on the hook for $40M over pharmacy monkey business; $6M windfall for whistleblower

One of the largest food retailers in the world, and the fourth biggest grocery operator in the United States, has agreed to pay $40 million to settle allegations that it cheated on drug prices charged to federal healthcare programs. The settlement resolves claims that the company knowingly submitted false pricing information for prescription drugs to Medicare and Medicaid. According to the U.S. Department of Justice, the grocery chain inflated the prices it reported for certain medications, causing the government to overpay for those drugs over a period of several years.

The case was brought to light by a former employee who worked in the company's pharmacy division. That whistleblower filed a lawsuit under the False Claims Act, which allows private citizens to sue on behalf of the government and share in any recovery. For providing detailed evidence of the pricing scheme, the whistleblower will receive $6 million from the settlement. The company did not admit wrongdoing as part of the agreement but said it was cooperating with the investigation and has since updated its pricing practices. The settlement is one of the largest ever involving a grocery chain's pharmacy operations.
